A medical negligence claim is a legal action alleging that a healthcare professional or provider failed to meet the appropriate standard of care and that this caused injury, illness or other loss. A poor outcome or recognised treatment risk does not automatically mean negligence; the evidence must support both a breach of duty and a link to the harm suffered. In England and Wales, claims are generally subject to a three-year time limit, although exceptions can apply. A solicitor regulated by the SRA can assess the circumstances, records and available evidence.
